New regulations on the marketing of food supplements

Starting with 04.04.2021 Law no. 56/2021 on food supplements and their marketing regime on the Romanian market entered into force. This normative act transposes the European directives that deal with the legal regim of food supplements.
According to this normative act, all food supplements will be legally traded on the Romanian market based on the notification certificate issued by the Ministry of Health (through specialized structures). It is a contravention to place on the market food supplements for which the notification certificate has not been issued or which does not comply with the current legal provisions and will be sanctioned by the National Authority for Consumer Protection.
Regarding the notification procedure, the new normative act brings as a novelty the way in which a product, already notified in another EU member state, is introduced on the Romanian market. Thus, for these categories of products (respectively those already notified in another Member State) the notification procedure has been simplified, being necessary only the product label and the document attesting the notification in another state. These documents are submitted to the competent structures within the Ministry of Health, and the notification certificate will be issued.
It should be noted that the action of selling food supplements without a notification certificate is sanctioned with a contravention fine between 13,000 lei and 15,000 lei and the final cessation of marketing.
